Terms of Service

1. Introduction & Acceptance of Terms
Welcome to PDFik.net (βPDFikβ, βweβ, βusβ, or βourβ), a PDF generation API platform operated as a sole-trader business (Jednoosobowa DziaΕalnoΕΔ Gospodarcza) registered in Poland under Polish law. Our registered contact address is available upon request at [email protected].
These Terms of Service (the βTermsβ) constitute a legally binding agreement between you (the βCustomerβ, βyouβ, or βyourβ) and PDFik.net governing your access to and use of the PDFik.net website located at https://pdfik.net, its subdomains, the PDF generation API, associated developer tools, dashboards, documentation, and any related services (collectively, the βServiceβ).
By registering for an account, clicking βI Agreeβ, accessing the Service, or using any PDFik.net API endpoint, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.
If you are entering into these Terms on behalf of a legal entity such as a company or organisation, you represent and warrant that you have the legal authority to bind that entity, in which case βyouβ and βyourβ refer to that entity. PDFik.net reserves the right to request proof of such authority at any time.
2. Eligibility
To register for and use the Service, you must meet all of the following eligibility requirements:
- Age: You must be at least 18 years of age. By registering, you represent and warrant that you are 18 or older. The Service is not directed at or intended for use by minors.
- Legal capacity: You must have the full legal capacity to enter into a binding contract under the laws applicable to you. Persons who are legally prohibited from entering into contracts may not use the Service.
- Business use: The Service is designed and offered primarily for professional, business, and developer use. You may use the Service for personal projects, but you acknowledge the Service is provided with a commercial focus and features.
- One account per entity: Each individual person or legal entity may maintain only one active PDFik.net account. Creating multiple accounts to circumvent quotas, abuse the Free plan, or evade a suspension is a material breach of these Terms and will result in immediate termination of all associated accounts.
- Sanctions compliance: You must not be a person or entity subject to trade or economic sanctions imposed by the European Union, the United States, the United Nations, or any other applicable jurisdiction. PDFik.net reserves the right to verify compliance and to refuse or terminate service to sanctioned parties at any time.
PDFik.net reserves the right to refuse registration or access to the Service to any person or entity at its sole discretion, subject to applicable law.
3. Account Registration & Security
Account registration is performed via Google Firebase Authentication. By signing in with your Google account, you authorise PDFik.net to receive your name and email address from Google for the purpose of creating and managing your account.
You are solely responsible for:
- Maintaining the confidentiality and security of your login credentials, API keys, and any access tokens associated with your account.
- All activity that occurs under your account, including any actions taken by employees, contractors, or third parties to whom you have granted access.
- Ensuring that your account information, including your email address and payment details, is kept accurate and up to date at all times.
- Immediately notifying us at [email protected] if you suspect any unauthorised access to or use of your account.
PDFik.net will not be liable for any loss or damage arising from your failure to maintain the security of your account credentials. We reserve the right to disable any account we reasonably suspect has been compromised, without prior notice, in order to protect the security of the Service and other users.
You may not share your account with other individuals or entities. Account credentials and API keys are issued to the registered account holder and must not be transferred, sold, or sublicensed.
4. Payment Method Requirement
A valid payment method is required for all PDFik.net accounts, including accounts on the Free plan. This requirement exists to prevent abuse of the Service, ensure fair use among all users, deter the creation of multiple accounts to circumvent quotas, and to facilitate seamless plan upgrades.
Payment methods are registered and stored securely through Stripe, our third-party payment processor. PDFik.net never directly stores, processes, or has access to your full card number, CVV, or other sensitive payment card data. Card registration is performed via a Stripe SetupIntent flow, which tokenises your payment method for future use. By adding a payment method, you authorise PDFik.net to charge your card for applicable subscription fees.
Free plan accounts: No charges will be applied to your payment method as long as your account remains on the Free plan. Your card is held on file solely for verification purposes and will only be charged if you voluntarily upgrade to a paid plan or if usage charges are otherwise authorised under these Terms.
4.1 Account Status: Active & Inactive
Your account can be in one of two states:
- Active: Your account has a valid payment method on file. All API keys function normally and PDF generation is permitted within your plan's quota limits.
- Inactive: Your account does not have a valid payment method on file. In the Inactive state, all API keys are disabled, and all PDF generation requests will be rejected. You will still be able to log in to the dashboard and manage your account settings, but the API will not function until a valid payment method is added.
Your account becomes Inactive in the following circumstances:
- You remove your payment method from the dashboard without adding a replacement.
- Your stored payment method is declined, expired, or otherwise invalidated by Stripe.
- A payment dispute or chargeback results in the removal of your payment method.
Reactivation: Your account will return to Active status immediately upon the successful addition of a valid payment method via the billing section of your dashboard. You do not need to contact support to reactivate β the process is fully self-service. PDFik.net will send you email notifications when your account transitions to Inactive status.
5. Subscription Plans & Billing
5.1 Available Plans
PDFik.net offers the following subscription plans (prices listed in USD, exclusive of applicable taxes):
Each plan includes two monthly allowances: a number of PDF generations and a volume of generated output data (GB). A render is accepted only while both allowances have remaining headroom; whichever is reached first limits further generation until the monthly window resets or the plan is upgraded. The data allowance measures rendered output only β downloading generated files does not consume it.
- Free β $0/month: Up to 100 PDF generations and 0.5 GB of generated output per month. A valid payment method is required (verified, not charged). Intended for evaluation and low-volume use.
- Starter β $29/month ($23/month billed annually): Up to 5,000 PDF generations and 10 GB of generated output per month. Suitable for small projects and early-stage products.
- Pro β $99/month ($79/month billed annually): Up to 50,000 PDF generations and 50 GB of generated output per month. Suitable for production applications with significant volume. Includes a 99.5% uptime SLA.
- Business β $449/month ($359/month billed annually): Up to 500,000 PDF generations and 300 GB of generated output per month. Designed for high-volume enterprise use. Includes priority support and a 99.5% uptime SLA. Additional generated-data volume may be purchased in 1 GB increments (see 5.6).
The following limits apply on all plans, including Free: each generated file may be up to 150 MB (larger outputs fail with a size error; a per-account increase may be requested from support); generated files remain available for download for 24 hours after generation and are then deleted; and each account is subject to per-plan API rate and concurrency limits. The current numeric limits for every plan are published at docs.pdfik.net/rate-limits and form part of these Terms.
Plan features, limits, and pricing are subject to change. PDFik.net will provide at least 14 days' notice of material changes to pricing for existing subscribers.
5.2 Billing Cycles
Paid subscriptions are available on a monthly or annual billing cycle. Monthly subscriptions are billed on the same calendar date each month. Annual subscriptions are billed once per year and typically offered at a discount compared to the monthly equivalent.
All subscriptions renew automatically at the end of each billing period using the payment method on file, unless you cancel before the renewal date. Renewal charges will be processed by Stripe on your renewal date. It is your responsibility to ensure your payment method is valid and has sufficient funds prior to any renewal date.
You will receive an email receipt from Stripe for each successful charge. If a payment fails, PDFik.net will attempt to notify you and may retry the charge. Persistent payment failure may result in your account transitioning to Inactive status.
5.3 Upgrades & Downgrades
You may upgrade or downgrade your subscription plan at any time from your account dashboard.
- Upgrades take effect immediately. You will be charged a prorated amount for the remainder of your current billing period at the new plan rate.
- Downgrades take effect at the start of the next billing period. You will continue to have access to your current plan's features and quota until the period ends. Unused quota does not carry over between billing periods.
5.4 Quota Overages
PDFik.net enforces hard quota limits per billing period on both monthly allowances. When you reach your plan's monthly PDF generation limit, the API returns an HTTP 402 (Payment Required) error for subsequent requests. When you reach your monthly generated-data (GB) allowance, the API returns an HTTP 429 (Too Many Requests) error. In both cases your API keys are not automatically charged for overages, and no additional fees are incurred beyond your subscription and any volume add-on you have purchased (see 5.6). To continue generating after reaching a quota, you must upgrade to a higher-tier plan, purchase additional data volume where available, or wait until your next billing period begins, at which point your quotas reset.
5.5 Taxes
Subscription fees are exclusive of taxes. Where applicable, value-added tax (VAT) or other taxes may be added by Stripe at the point of charge, based on your billing country. EU business customers with a valid VAT number may be eligible for reverse charge (zero-rated) invoicing. You are responsible for providing accurate billing information and for any taxes owed in your jurisdiction.
5.6 Volume Add-Ons
Business-plan subscribers may purchase additional monthly generated-data volume in increments of 1 GB, at the per-GB rate shown in your billing console, up to a self-service ceiling; larger volumes may be arranged with support. Add-on volume is billed on the same cycle (monthly or annual) as your base subscription, is prorated by Stripe when it is added or changed, and is added to your plan's included data allowance for each billing period for as long as it remains active. Add-on charges are non-refundable except where required by law or as stated in Section 6. Add-ons do not change your PDF-generation allowance.
6. Refund Policy
6.1 Monthly Subscriptions
Monthly subscription fees are non-refundable once the billing cycle has commenced. If you cancel a monthly subscription, you will retain access to the paid plan features until the end of the current billing period. No partial or prorated refunds are issued for unused days on monthly plans.
6.2 Annual Subscriptions
If you purchase an annual subscription and are dissatisfied with the Service, you may request a pro-rata refund within 14 days of the original purchase date. The refund will cover the unused full months remaining in the annual term, calculated from the date your cancellation request is received. Refund requests after 14 days of purchase are not accepted for annual subscriptions.
6.3 Service Credits for Outages
In the event of a verified service outage that breaches the applicable Service Level Agreement (SLA) for your plan, PDFik.net will issue service credits to your account, in accordance with the SLA terms described in Section 10. Service credits are applied to future invoices and are not redeemable for cash and have no monetary value outside the Service.
6.4 Disputed Charges
If you believe you have been charged in error, please contact us first at [email protected] with details of the disputed charge. We will investigate and respond within 5 business days. Initiating a chargeback with your card issuer or Stripe without first contacting us may result in the suspension of your account and may incur dispute fees passed on by Stripe.
6.5 No Refunds for ToS Violations
No refunds, prorated or otherwise, will be issued if your account is suspended or terminated due to a violation of these Terms of Service, our Acceptable Use Policy, or any applicable law.
7. API Usage & Key Management
7.1 API Keys as Account Credentials
API keys issued to your account are confidential credentials equivalent to a username and password. You must:
- Store API keys securely β for example in environment variables or a secrets manager β and never embed them in public source code repositories or client-side code.
- Rotate API keys immediately if you suspect they have been exposed or compromised.
- Limit access to API keys to only those systems and personnel that require them.
You are solely responsible for all activity conducted using your API keys, regardless of whether such activity was authorised by you. PDFik.net will treat any request made with a valid API key as an authorised request from your account and will count it against your quota accordingly.
7.2 Webhooks & Signature Verification
PDFik.net may deliver webhook events to a URL you configure in your dashboard. All outbound webhook payloads are signed using HMAC-SHA256 and include an X-PDFik-Signature header. You are required to verify this signature on every received webhook before processing the payload. Failure to verify webhook signatures may expose your systems to forged requests. PDFik.net accepts no liability for damage arising from your failure to implement signature verification.
7.3 No Reselling of API Access
You may not resell, sublicense, redistribute, or otherwise provide access to the PDFik.net API to third parties as a standalone service. You may integrate the API into your own products and services to generate PDFs on behalf of your end users, but you may not white-label or productise the API itself for resale without a separate written agreement with PDFik.net. Contact [email protected] to enquire about reseller or OEM arrangements.
7.4 Rate Limits & Quotas
In addition to monthly generation quotas, the API enforces per-second and per-minute rate limits to ensure fair access and system stability for all users. These limits are documented in the API documentation. Sustained attempts to exceed rate limits may result in temporary IP-level throttling or account suspension. PDFik.net reserves the right to adjust rate limits at any time to protect service availability.
8. Acceptable Use Policy
You agree to use the Service only for lawful purposes and in a manner consistent with all applicable local, national, and international laws and regulations. The following uses are strictly prohibited:
- Illegal content: Generating, transmitting, or storing PDFs that contain or facilitate illegal activity, including but not limited to fraud, phishing, money laundering, or the distribution of controlled substances.
- Child sexual abuse material (CSAM): Any use of the Service to generate, transmit, or store material that sexually exploits minors is absolutely prohibited and will be reported to the relevant authorities.
- Malware delivery: Using the Service to generate documents that embed, distribute, or facilitate the delivery of malicious code, ransomware, spyware, or any other harmful software.
- SSRF and network boundary violations: Submitting URLs or HTML payloads designed to probe, access, or exploit PDFik.net's internal infrastructure, cloud services, or internal network endpoints (Server-Side Request Forgery). All submitted URLs and external resources loaded within documents must strictly resolve to public, globally routable domain names or public IP addresses. Requests targeting private address spaces, loopback addresses, local network segments, or cloud metadata endpoints are strictly blocked and prohibited by policy.
- Forbidden redirects and evasion: Attempting to bypass domain or network validation through HTTP/HTTPS redirects, DNS rebinding, or dynamic URL redirect chains. All redirects during document rendering are strictly blocked at the network layer. Any attempt to evade security checks or access non-public network boundaries will result in immediate account suspension and termination.
- Denial of Service: Attempting to degrade, overwhelm, or disrupt the Service or its infrastructure through excessive requests, resource exhaustion, or any other means.
- Competitor scraping: Using the Service to scrape, harvest, or extract data from competitor websites or services in violation of their terms of service.
- Impersonation: Generating PDFs that impersonate PDFik.net, other companies, government bodies, or individuals in a deceptive or fraudulent manner.
- Spam: Using the Service to generate bulk unsolicited communications, marketing materials, or spam content.
- Multi-account abuse: Creating multiple PDFik.net accounts β whether under the same or different identities β for the purpose of circumventing quota limits, abusing the Free plan, or evading an account suspension.
- Sanctions violations: Using the Service in contravention of applicable trade sanctions, embargoes, or export control laws.
Copyright responsibility: You are solely responsible for ensuring that any HTML, URLs, assets, or content you submit to the Service for PDF generation does not infringe the intellectual property rights of third parties. PDFik.net acts as a neutral technical processor and does not monitor or review submitted content for copyright compliance. Any claims arising from copyright infringement in your generated PDFs are your sole responsibility.
PDFik.net reserves the right to investigate any suspected violation of this Acceptable Use Policy and to suspend or terminate accounts found to be in violation, without prior notice and without refund.
9. Data, Content & Intellectual Property
9.1 Your Content & Generated PDFs
You retain full ownership of all input data (HTML, URLs, assets, parameters) you submit to the Service (βCustomer Contentβ) and of all PDF documents generated by the Service on your behalf (βGenerated Outputβ). PDFik.net does not claim any ownership, licence, or intellectual property rights in your Customer Content or Generated Output, except as strictly necessary to provide the Service.
9.2 Licence to Process Your Content
By submitting Customer Content to the Service, you grant PDFik.net a limited, non-exclusive, worldwide, royalty-free licence to access, load, render, convert, and store your Customer Content solely for the purpose of providing the PDF generation Service to you. This licence terminates when the content is deleted from our systems in accordance with our data retention policy.
9.3 Content Retention
Generated PDF files stored on PDFik.net infrastructure (AWS S3, region us-east-1) are available for download for 24 hours after generation; files are physically deleted within 48 hours. You may request deletion of specific files at any time by contacting [email protected]. It is your responsibility to download and retain any Generated Output you wish to keep beyond this window.
9.4 PDFik.net Intellectual Property
The PDFik.net name, logo, brand, website, API, platform code, documentation, and all related technology remain the exclusive intellectual property of PDFik.net and its licensors. Nothing in these Terms grants you any right to use PDFik.net's trademarks, service marks, or branding without prior written consent. You may not copy, reverse engineer, decompile, disassemble, or create derivative works of any part of the Service.
10. Service Availability & SLA
PDFik.net targets the following monthly uptime levels for each plan:
- Free plan: Best-effort availability. No uptime guarantee is provided. Free plan users may experience reduced availability during periods of high load or maintenance.
- Paid plans (Starter, Pro, Business): Target monthly uptime of 99.5%.
Full SLA details, including definitions, downtime calculation methodology, credit schedules, and exclusions, will be published at /legal/sla and form part of these Terms for paid plan subscribers.
10.1 Scheduled Maintenance
PDFik.net performs periodic maintenance on its infrastructure. Where possible, scheduled maintenance will be conducted during low-traffic periods. For maintenance expected to cause more than 30 minutes of downtime, PDFik.net will provide at least 48 hours' notice via email and/or a status page announcement at status.pdfik.net. Scheduled maintenance windows do not count towards SLA downtime calculations.
10.2 Force Majeure
PDFik.net shall not be liable for any failure or delay in performing its obligations under these Terms caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, epidemics or pandemics, failures of third-party infrastructure (including AWS, Stripe, or internet backbone providers), or power outages. In such events, PDFik.net will make reasonable efforts to notify users and restore service as quickly as practicable.
11. Limitation of Liability
11.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN βAS ISβ AND βAS AVAILABLEβ BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PDFIK.NET EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. PDFIK.NET DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.
Nothing in this section limits statutory rights that cannot be waived under applicable Polish or EU consumer protection law.
11.2 Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PDFIK.NET'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE β WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR OTHERWISE β SHALL NOT EXCEED THE TOTAL FEES ACTUALLY PAID BY YOU TO PDFIK.NET IN THE THREE (3) CALENDAR MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. FOR FREE PLAN USERS, THIS AMOUNT SHALL BE ZERO.
11.3 Exclusion of Consequential Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PDFIK.NET BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF BUSINESS OPPORTUNITY, OR BUSINESS INTERRUPTION, EVEN IF PDFIK.NET HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11.4 Mutual Indemnification
You agree to indemnify, defend, and hold harmless PDFik.net and its officers, employees, agents, and successors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service in violation of these Terms; (b) your Customer Content; (c) your violation of any applicable law or the rights of a third party; or (d) any claim by your end users arising from your product or service.
PDFik.net agrees to indemnify and hold you harmless from claims arising directly from PDFik.net's gross negligence or wilful misconduct, subject to the liability cap set out in Section 11.2.
12. Account Suspension & Termination
12.1 Suspension for Violations
PDFik.net reserves the right to immediately suspend or restrict your account and API access β without prior notice β if we have reasonable grounds to believe that you have violated these Terms, the Acceptable Use Policy, or any applicable law. We will make reasonable efforts to notify you by email of the reason for suspension as soon as practicable after the action is taken. Suspended accounts retain their data but cannot access the API.
12.2 Suspension for Missing Payment Method
As described in Section 4, an account without a valid payment method on file will be placed into Inactive status, which disables all API keys and blocks PDF generation. This is distinct from a punitive suspension and may be resolved by adding a valid payment method.
12.3 Termination by PDFik.net
PDFik.net may terminate your account and these Terms without cause upon 30 days' written notice delivered to the email address associated with your account. If your account is terminated without cause, you will receive a prorated refund of any prepaid subscription fees for the unused portion of your current billing period.
12.4 Termination by You
You may cancel your account at any time via the account settings in your dashboard. Cancellation takes effect at the end of your current billing period for paid plans. For Free plans, cancellation is immediate. Upon cancellation, your API keys will be deactivated at the effective cancellation date.
12.5 Data Export & Post-Termination
Following the effective termination of your account for any reason, you will have a period of 30 calendar days during which you may log in to your account to export your data and download any Generated Output files still within retention. After this 30-day window, your account data β including all Generated Output, API keys, and account information β will be permanently deleted from PDFik.net's systems. Notwithstanding the foregoing, billing and accounting records (including issued invoices) are retained for the period required by applicable law β in particular Polish accounting regulations β even after the 30-day deletion described above. PDFik.net accepts no liability for data loss arising from your failure to export your data within the 30-day post-termination window.
12.6 Survival
The following sections survive termination of these Terms: Section 8 (Acceptable Use Policy), Section 9.4 (PDFik.net Intellectual Property), Section 11 (Limitation of Liability), Section 16 (Governing Law & Dispute Resolution), and any other provisions that by their nature should survive.
13. Privacy & Data Processing
PDFik.net processes personal data in accordance with applicable data protection law, including the EU General Data Protection Regulation (GDPR) and the Polish Act on the Protection of Personal Data. Our full Privacy Policy, which describes what data we collect, how we use it, your rights as a data subject, and our data retention practices, is available at:

Where PDFik.net processes personal data on behalf of business customers as a Data Processor (for example, where Customer Content submitted to the API contains personal data of your end users), PDFik.net acts as your Data Processor and you act as the Data Controller within the meaning of the GDPR.
Business customers who require a formal Data Processing Agreement (DPA) for GDPR compliance purposes may request one by contacting [email protected]. By using the Service to process personal data of third parties, you represent that you have a lawful basis for such processing and that you have provided the necessary notices to your data subjects.
PDFik.net's infrastructure is hosted on AWS in the us-east-1 (Northern Virginia) region. Transfers of personal data outside the European Economic Area are conducted pursuant to the EU Standard Contractual Clauses (SCCs) or another lawful transfer mechanism as described in our Privacy Policy.
14. Changes to Terms
PDFik.net reserves the right to modify these Terms at any time. For material changes β including changes that affect your rights, obligations, pricing, or the core features of the Service β PDFik.net will provide at least 14 days' advance notice via email to the address associated with your account and/or by posting a prominent notice on the Service.
Non-material changes (such as formatting corrections, clarifications, or updates to contact information) may be made at any time without prior notice.
The βLast updatedβ date at the top of this page reflects the date of the most recent revision. Changes will become effective on the date stated in the notice or update. Your continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may cancel your account as described in Section 12.4.
We encourage you to review these Terms periodically. All previous versions of the Terms are available upon request.
15. Communications
15.1 Transactional & Security Communications
By creating an account, you agree to receive transactional and service-related communications from PDFik.net. These include but are not limited to: account registration confirmations, payment receipts and invoices, billing failure notifications, account status changes (e.g., Active/Inactive transitions), security alerts, API key activity warnings, material changes to these Terms, and service outage notifications.
These communications are sent on the basis of contractual necessity and legitimate interest and do not require your separate marketing consent. You cannot opt out of receiving transactional and security emails while you maintain an active account. These emails form part of the Service.
15.2 Marketing Communications
PDFik.net may send you optional marketing emails about new features, promotions, and company updates. Marketing emails will only be sent if you have provided your consent, in accordance with applicable law. You may opt out of marketing emails at any time by clicking the unsubscribe link in any marketing email or by updating your communication preferences in your account dashboard. Opting out of marketing emails will not affect transactional communications.
15.3 Official Notices

16. Governing Law & Dispute Resolution
16.1 Governing Law
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of Poland (Prawo Polskie), without regard to its conflict of law provisions.
If you are a consumer resident in the European Union, you will also benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms derogates from your rights as a consumer under applicable EU law, including the Consumer Rights Directive and the Unfair Contract Terms Directive.
16.2 Informal Resolution
Before initiating any formal legal proceedings, both parties agree to first attempt to resolve any dispute informally. The party raising the dispute shall provide written notice to the other party describing the nature of the dispute and the relief sought. The parties will then attempt to resolve the matter through good-faith negotiation for a period of 30 calendar days from receipt of the written notice, unless both parties agree to extend this period.
16.3 Jurisdiction
If a dispute cannot be resolved through informal negotiation, it shall be submitted to the exclusive jurisdiction of the courts competent for the registered seat of PDFik.net (SΔ d wΕaΕciwy dla siedziby PDFik.net) in Poland. For EU consumers, disputes may alternatively be brought before the courts of your country of residence, in accordance with applicable EU law.
16.4 EU Online Dispute Resolution (ODR)
If you are a consumer resident in the European Union, you may also make use of the European Commission's Online Dispute Resolution platform (EU ODR), which provides an online tool for resolving disputes between consumers and online traders. The EU ODR platform is available at: https://ec.europa.eu/consumers/odr.
16.5 Class Action
PDFik.net does not seek to apply a class action waiver. Applicable Polish and EU law does not generally permit the enforcement of class action waiver clauses against consumers. Each party retains the right to bring individual claims before courts of competent jurisdiction. Where collective or representative action mechanisms exist under Polish or EU law, these are not restricted by these Terms.
